The https://haiboxing.com  (‘website’, ‘site’ or ‘webpage’) is owned and operated by HAIBOXING, carrying on its business activities in the United States. These Terms of Use govern your use of this SHANTOU HAIBOXING website services.

1.    YOUR ACCEPTANCE OF THESE TERMS OF USE

These Terms of Use hereinafter referred to as “TOU” constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and SHANTOU HAIBOXING INC., (“SHANTOU HAIBOXING, we,” “us” or “our”), concerning your access to and use of  the website and any other media form, media channel, related, linked, or otherwise connected thereto (collectively, “the site” or HAIBOXING”). You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these TOU Use.  IF YOU DO NOT AGREE WITH ALL OF THESE TOU, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental TOU or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these TOU at any time and for any reason.  We will alert you about any changes by updating the “Last updated” date of these TOU and you waive any right to receive specific notice of each such change.  It is your responsibility to periodically review these TOU to stay informed of updates.  You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised TOU by your continued use of the Site after the date such revised Terms are posted.

By agreeing to these TOU, you agree to the terms of our Privacy policy which is expressly incorporated herein. Before using this Site, please carefully review our Privacy Policy. All information provided to us as a result of your use of this Site will be handled in accordance with our Privacy Policy. To the extent there are inconsistencies between these Terms of Use and our Privacy Policy, these Terms of Use control.

• You agree to contact our customer service department immediately of any breach of security or unauthorized use of your Account or any violation of these Terms by others of which you are aware. You agree that we shall have no liability for any losses, damages, liabilities or expenses you may incur due to any unauthorized use of your Account, and you agree to indemnify us and hold us harmless for any such unauthorized use. We reserve the right to create accounts for quality control and administrative purposes. Such accounts may be publicly viewable.

 

6.      PRODUCTS AND ORDERS

All products displayed on our website are subject to availability and may be withdrawn at any time without notice. We make every effort to ensure product descriptions, images, and prices are accurate; however, errors may occur. We reserve the right to:

·         Refuse or cancel any order for reasons including stock unavailability, pricing errors, or suspected fraudulent activity.

·         Limit quantities purchased per person or per order. Once an order is confirmed, you will receive an email acknowledgment. This does not constitute acceptance until payment is verified, and the order is dispatched.

7.    PRE TESTING

Please check your item BEFORE USE. You should carry out checks and tests before using e.g. test all radio equipment including a range test. Should you fail to carry out any relevant checks and damage is incurred as a result we will not be held responsible. Our help pages and your manual will include information on what procedures to follow. If you require details on how to check your model before use, please ask us do not proceed to use your model until you are clear on the pre checks needed. 

These models are NOT TOYS. If you have no experience with the model you have purchased you will need to do some research e.g. if you have purchased a model then as well as reading all the information on our site and in the product manual you should do some research on how to e.g. tune and set your engine and also how to check it before use. We will offer advice and help newcomers as much as possible but are unable to accept returns for items that have been damaged by incorrect use, from customers who are unable to adjust their models or from customers who have not fully checked their models before use.

8.    LITHIUM POLYMER BATTERIES (LIPO, LI-POLY)

Fire can be caused by but not limited to: Overcharging your battery, using the wrong charger or charger setting, unbalanced battery load, charger fouled by poor power supply, charging a damaged cell or pack, short circuit, crash damage, Over discharging, running too flat and/or too hot, discharging an unbalanced battery load, charging the battery whilst still in your rc model, charging in a car, charging from car battery, punctured battery. It is highly recommended you read up on safe use of your Li Po battery before use and first charge

Charging guidelines:

1. Always charge on a surface that cannot catch fire easily, concrete, steel etc... Do not charge on carpet, paper or any other items that can catch fire easily!

2. Never over discharge your battery.  What does this mean? 

It means when you notice a power drop (when using your helicopter), stop! Immediately!

It also means disconnect your battery from the helicopter, even if you switch off the helicopter or transmitter and you leave it connected it will still discharge really slowly. Really slowly for a day is a lot!

If you over discharge and then charge again you may experience puffing. This is where the cells swell.  If this happens you can never use the battery again. If you charge a puffed battery then expect a fire!

 3. Always remove your battery from your rc model when charging.

 4. Use the correct charger.

5. Do not overcharge your battery. Always set a timer and don’t leave your battery charging un attended. If you do not know the charging time of your battery give us a call or emails us before you attempt to charge.

Lipo batteries are expensive and can be dangerous so need to be treated with care, if you need any help with charging email me us or give us a call. It is highly recommended you read up on safe use of your Li Po battery before use and first charge

 

9.    USER CONDUCT

• You agree that you will not violate any law, contract, intellectual property or other third party right or commit a tort, and that you are solely responsible for your conduct, while accessing or using the Sites.
• You agree that you will abide by these Terms and will not: Engage in any harassing, threatening, intimidating, predatory or stalking conduct;
• You agree that you will not use or attempt to use another user’s account without authorization from such user and HAIBOXING.
• You agree that you will not use the Sites in any manner that could interfere with, disrupt, negatively affect or inhibit other users from fully enjoying the Sites or that could damage, disable, overburden or impair the functioning of the Sites in any manner;
• You agree that you will not do anything that might discover source code or bypass or circumvent measures employed to prevent or limit access to any Content, area or code of the Sites;
• You agree that you will not attempt to circumvent any content-filtering techniques we employ.
• You agree that you will not access any feature or area of the Sites that you are not authorized to access.
• You agree that you will not develop any third-party applications that interact with the Sites without our prior written consent.
• You agree not to use any robot, spider, crawler, scraper, script, browser extension, offline reader or other automated means or interface not authorized by us to access the Sites, extract data or otherwise interfere with or modify the rendering of Site pages or functionality.
• You agree that you will not bypass or ignore instructions contained in the robots.txt file, that controls all automated access to the Sites or Use the Sites for any illegal or unauthorized purpose, or engage in, encourage or promote any activity that violates these Terms.

 

10.   PRICING AND PAYMENT

All prices displayed on our website are quoted in United States Dollars (USD) unless otherwise specified. Prices are subject to change without prior notice due to market conditions, currency fluctuations, or other factors beyond our control. We strive to ensure that all pricing information is accurate; however, errors may occur. In the event of a pricing error, we reserve the right to cancel any order placed at an incorrect price, even after confirmation.

We accept PayPal and major credit cards as secure payment methods. By submitting payment details, you represent and warrant that:

• You are legally authorized to use the payment method provided.
• The information you provide is accurate and complete. Payment must be received in full before we process and ship your order. We do not store credit card details on our servers; all transactions are processed through secure, encrypted payment gateways. Any additional fees, such as currency conversion or bank charges, are the responsibility of the customer.

 

11.   SHIPPING AND DELIVERY

We aim to process and dispatch all confirmed orders within five (5) business days. Shipping times vary depending on the destination and local customs regulations:

• North America: Estimated delivery within 7–12 business days after shipment.
• Europe and Americas: Estimated delivery within 10–15 business days after shipment.
• Other regions: Delivery timelines depend on local logistics and customs clearance.

We partner with reputable logistics providers, including COE, GOFO, Speedx, USPS, DEDHL, laposte, Colis Prive, canadapost, UNIUNI, expressone, among others. While we make every effort to ensure timely delivery, please note that delivery dates are estimates and not guaranteed. Delays caused by customs inspections, adverse weather conditions, or other factors beyond our control are not our responsibility. Customers are encouraged to track their shipments using the provided tracking number.

 

12.   FAILED DELIVERIES

We take every precaution to ensure successful delivery. However, if delivery fails due to incorrect recipient information provided by the customer:

• We will notify you via email and advise you to collect the package from your local postal service or designated pickup point.
• We are not liable for packages that remain unclaimed or are destroyed due to incorrect details.

If delivery fails or the package is lost due to reasons attributable to us or our logistics partners, we will:

• Reship the order at no additional cost, or
• Issue a full refund to the original payment method. Please note that claims for failed deliveries must be submitted within 14 days of the estimated delivery date. We reserve the right to request supporting documentation before processing refunds or reshipments.

 

13.   INTELLECTUAL PROPERTY

All content, materials, and intellectual property displayed or made available on the website https://haiboxing.com, including but not limited to text, graphics, logos, product images, videos, audio clips, software, design elements, and the overall look and feel of the site (collectively, “Content”), are the exclusive property of Haiboxing or its licensors. These materials are protected under applicable copyright, trademark, and intellectual property laws in the United States, Germany, France, and other jurisdictions.

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the website solely for personal, non-commercial purposes. This license does not permit:

• Copying, reproducing, distributing, or modifying any Content without prior written consent.
• Using any trademarks, logos, or brand identifiers belonging to the Company without authorization.
• Reverse-engineering, decompiling, or attempting to extract source code from any software or functionality provided on the website.

HAIBOXING shall not be liable for the use or content of Internet sites that link to this site, or which are linked from it. Our privacy and cookie notice do not apply to any collection and processing of your personal data on or through such external sites.

15.   YOUR REPRESENTATIONS AND WARRANTIES

You hereby represent and warrant that: (i) you will only use HAIBOXING as permitted under these Terms; (ii) you agree to comply with all applicable laws, rules and regulations, and industry best practices while using HAIBOXING; (iii) you will not use HAIBOXING for any fraudulent or inappropriate purpose; (iv) you shall not prevent others from using HAIBOXING.

16.   LIMITATION OF LIABILITY

TO THE EXTENT PERMITTED UNDER APPLICABLE LAW, UNDER NO CIRCUMSTANCES SHALL WE, OUR OFFICERS, DIRECTORS, EMPLOYEES, PARENTS, AFFILIATES, SUCCESSORS, ASSIGNS, OR LICENSORS BE LIABLE TO YOU OR ANY OTHER THIRD PARTY FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES OF ANY TYPE INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER FAILURE OR MALFUNCTION, LOSS OF BUSINESS PROFITS, LOSS OF DATA OR BUSINESS INFORMATION, LOSS OF ADDITIONAL SOFTWARE OR COMPUTER CONFIGURATIONS OR COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, DAMAGES ARISING IN CONNECTION WITH ANY USE OF SHANTOU HAIBOXING OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE INSTALLATION, UNINSTALLATION, USE OF OR INABILITY TO USE SHANTOU HAIBOXING UNDER ANY THEORY OF LIABILITY, INCLUDING BUT NOT LIMITED TO CONTRACT OR TORT (INCLUDING PRODUCTS LIABILITY, STRICT LIABILITY AND NEGLIGENCE), AND WHETHER OR NOT WE WERE OR SHOULD HAVE BEEN AWARE OR ADVISED OF THE POSSIBILITY OF SUCH DAMAGE AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY STATED HEREIN. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, IN NO EVENT SHALL OUR TOTAL LIABILITY (INCLUDING OUR OFFICERS, DIRECTORS, EMPLOYEES, PARENTS, AND AFFILIATES) FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS, TO THE FULLEST EXTENT POSSIBLE UNDER APPLICABLE LAW, EXCEED THE AMOUNT PAID IF ANY, BY YOU FOR THE USE OF SHANTOU HAIBOXING.

17.   INDEMNITY

You agree to defend, indemnify and hold us, our parent corporation, officers, directors, employees and agents, harmless from and against any and all claims, damages, obligations, losses, liabilities, costs and expenses (including but not limited to attorney's fees) arising from: (i) your access to or use of HAIBOXING; (ii) your violation of these Terms; or (iii) your violation of any third party right, including without limitation, any intellectual property right, or privacy right.

18.   GOVERNING LAW AND DISPUTES

These Terms and Conditions, as well as any disputes arising from or related to your use of the website https://haiboxing.com, our products, or services, shall be governed and construed in accordance with the laws of the United States of America, without regard to its conflict of law principles. Where applicable, certain provisions may also be subject to the laws of Germany and France, particularly for transactions involving customers located within those jurisdictions.

By using our website, you agree that:

• Any legal action or proceeding relating to these Terms shall be brought exclusively before the competent courts located in the United States, unless otherwise required by mandatory local laws.
• For customers in Germany and France, disputes may be resolved in accordance with local consumer protection laws and regulations, provided they do not conflict with these Terms.

You acknowledge and agree that you are responsible for complying with all applicable local laws in your jurisdiction when accessing and using our website. The Section headings in these Terms are provided for convenience purpose only and have no legal or contractual significance. If any provision of these Terms is held to be unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permissible so as to affect the intent of the parties, and the remainder of these Terms shall continue in full force and effect. Our failure to enforce any rights or to take action against you in the event of any breach hereunder shall not be deemed a waiver of such rights or of subsequent actions in the event of future breaches. These Terms and any right granted herein may not be assigned by you without our prior written consent. The controlling language of these Terms is English. In the event of inconsistency or discrepancy between the English version and any other language version, the English language version shall prevail. Nothing in these Terms will be construed as creating a joint venture, partnership, employment or agency relationship between you and us, and you do not have any authority to create any obligation or make any representation on our behalf.
